hereinafter as Seller.
- The Webshop sells spine-friendly products.
- The products depicted on the website are not only illustrations, but they are also accurate representations of the products sold.
- The products shown can only be ordered online via the Webshop’s software.
- The price of products usually does not include the delivery fee, in the case that it does, it will be indicated as such.
- The ordered product is delivered to the customer’s address by a courier, the customer may choose the method of payment.
- The indicated prices include tax.
Shipping fees
Shipping fees in Europe:
- See our chart for the fees and the time it takes for delivery to different countries.
- In the case of smaller products that are possible to send as letters in the mail, the shipping fee in the case of prepayment via bank transfer may be the price of postage.
- Packages are delivered all over Europe by GLS parcel service, the customer will receive two email notifications of the delivery. The second email will be sent on the morning of shipping and will contain the courier’s phone number with whom the customer may discuss the details. If delivery is unsuccessful, we will attempt delivery on an additional two days.
- The package contains the invoice. It is the customer’s responsibility to inspect the package in front of the courier and to request that a record is drawn up in the case of injuries to the package.
Registration
The webpage does not require registration.
The steps of concluding the electronic contract- The Customer is not obligated to register on the website in order to shop, they can initiate the order of any product by clicking the Order button on the page of each product.
- Clicking the Order button will lead the Customer to the Order page where they can indicate in the appropriate fields how many of the product they wish to purchase.
- Modification of the quantity of the product will automatically indicate the full price of the order along with the delivery fee.
- The Customer also provides their data necessary for delivery and invoicing on the Order page, they are obligated to provide accurate data.
- After filling out their data, the Customer is obligated to indicate that they accept the Seller’s General Contractual Conditions by marking the square provided for this purpose with an x, the order process ends when the Customer clicks on the Order button at the bottom of the page.
- Upon receiving the order, the Seller confirms the order to the Customer via email or calls them to inform them of the possible difficulties of delivery. The order and its confirmation are considered to have arrived when it becomes available to the Webshop as well as the Customer.
- If despite the appropriate care taken by the Seller, the wrong price is indicated on the Webshop interface, eg.: a price differing significantly from the product’s accepted or estimated price, an erroneous price due to a system error, then the Seller is not obligated to ship the product at the erroneous price. They may offer to ship the product at the correct price upon which the Customer, knowing the correct price, may withdraw from the transaction.
- When the user shopping at the Webshop sends the Order and the Webshop confirms it, based on Government Regulation 17/1999.(II.S.), a distance contract is concluded between the Seller as the seller and the Customer as the client, based on which the Customer entrusts the Seller to ship the ordered product to them to the address provided during the order process with the chosen payment and shipping conditions. In order to perform the shipment, the Seller delivers the ordered product.
- If the performance of the order is hindered in any way, the Seller is obligated to immediately contact the Customer via email or phone call in order to discuss further action.
- Ordered products are dispatched maximum three business days after the order is placed, in the case of prepayment via bank transfer, three business days after the purchase price arrives on the Webshop’s bank account.
- The Customer is obligated to take over the ordered and delivered products and to pay for them based on the fees they were informed of during the order process.
- The contract concluded via order and confirmation is not considered to be a written contract, it is not registered by the Webshop and will not be retrievable at a later date.
- Tools for providing the identification and correction of data entry errors before the contractual statement is sent: the contents of the Order page may be revised, modified and/or deleted at any time.
- If the Customer has by mistake ordered something they do not wish to purchase or if they provided incorrect data for the shipment and payment methods and only noticed afterward, they may notify the Seller of the problem via email or phone call.
Warranty / Guarantee
- According to the contents of Act IV of 1959 (PTK-Civil Code) and Government Regulation 151/2003. (IX. 22.), the Seller undertakes the minimum of a 12 month warranty period mandated by law for the products they sell. The warranty period may be longer for certain products and this is to be indicated on the product’s data sheet.
- If the Customer notices an error during regular use of the product, they should notify the Seller via their customer service email or phone number. After notifying the Seller they should package the product and mail it to the Seller’s address.
- The Seller inspects the product the Customer has sent back and if there is no factor to exclude the guarantor’s liability, they are to repair the faulty product or replace it.
- Factors that exclude guarantor’s liability:
- if the Customer damages the product during transportation or storage
- if the Customer damages the product by unprofessional use or application of force
- if the Customer damages the product via improper use
- if the product is damaged due to environmental factors
Right to withdrawal
- The right to withdrawal means that the Customer may, based on legal authorization, unilaterally withdraw from the contract concluded online without providing a reason and after having sent the product back may demand that the Seller refund the purchase price. The Customer may exercise their right to withdrawal within 14 calendar days of receiving the product. the right to withdrawal compensates for the fact that the Customer did not have the opportunity to inspect, try and operate the product before purchase.
- In the case of withdrawal the contract is terminated retroactively to the day it was concluded, thus the situation is as though the customer had never ordered the product. This also means that the Customer is obligated to return the product to the Seller at their own cost and the Seller is obligated to return the full purchase price to the Customer within 14 calendar days.
- According to the applicable legal regulations, if the Customer did not use the product appropriately, the Seller may claim damages for the faults and depreciation to the product due to irregular use.
- In the case of withdrawal in writing, it is enough to send the withdrawal statement within 14 calendar days.
